Bidding at an auction. This is a part of the buying process that swallows a lot of people up. Following the 4th #Cap545 auction failure for a project in Causeway Bay by mid April, a 5th auction failure was noted on 15th May. The existing property is a commercial block located on a corner site in Wanchai, close to Admiralty. Some highlights of this Wanchai Cap 545 failure case: - RDV hk$801 mil as at Sep 2023, as proposed by the valuer of the Applicant, was based on direct comparison method with reference to a #redevelopment project transaction nearby; - The judge of LT made a cross checking of the RDV assessment by using #residual method and assessed a lower RDV $707m, but agreed $801m as the Reserve price; - #RDV as at Sep 2023 was lower than the assessed aggregate #EUV of all units in the existing building $834.8m as at Mar 2022, i.e. before time adjustment; - There was a successful adverse possession claim by a stall operating at the side wall of the existing building in Feb 2024; - Though #HKIS raised the concern of the presence of squatters due to adverse possession, the gov’t seemed to have no intention yet to entertain such issue in the coming amendment to Cap 545 Ord.;  - A more recent offers by the Applicant to the three minority owners were $113.2m in total by Nov 2023, and the proceeds to be allocated to the minority owners would be $128.6m in total if the project were auctioned at the Reserve price.
