I recently published an article in English titled “Admissibility of Requests for a Preliminary Ruling in the Case Law of the CJEU on Judicial Independence” in Teisė, the legal journal of Vilniaus universitetas / Vilnius University. This article explores the underlying principles of the preliminary ruling procedure under Article 267 TFEU, which guide the ECJ in assessing the admissibility of requests from national courts on the interpretation of Article 19(1) TEU and the principle of judicial independence. The article focuses particularly on the concepts of “court or tribunal” within the meaning of Article 267 TFEU and the “necessity” of the Court’s ruling. I had the opportunity to present this article’s findings at the summer school hosted by the Universidad Internacional Menéndez Pelayo on July 25–26, organized by Juan Ignacio Signes de Mesa, Martín Martínez Navarro and the Academia de Práctica Jurídica Europea (APJE). My sincere thanks to them for the invitation to share this topic. #EUlaw #JudicialIndependence #CJEU #Article267 #Article19TEU https://lnkd.in/ew8PuyzW

Delighted to share that I recently had the privilege of participating in the esteemed International Moot Court Competition hosted by Sathyabama Institute of Science and Technology alongside my esteemed teammates, Ameen Ahamd Khan and Vishal Sejwar. Our focus delved deep into the intricate realm of international law, specifically addressing the poignant issue of genocide. The experience was nothing short of enriching, offering invaluable insights that I am eager to apply in future endeavors. Grateful for the opportunity to engage in such meaningful discourse. #MootCourt #InternationalLaw #Genocide #LegalEducation

#SMUYPHSL's Professor Yeo Tiong Min delivered the Yong Pung How Professorship of Law Lecture 2024 titled 𝘗𝘢𝘴𝘵, 𝘗𝘳𝘦𝘴𝘦𝘯𝘵, 𝘢𝘯𝘥 𝘍𝘶𝘵𝘶𝘳𝘦 𝘛𝘦𝘯𝘴𝘪𝘰𝘯𝘴: 𝘑𝘶𝘳𝘪𝘴𝘥𝘪𝘤𝘵𝘪𝘰𝘯 𝘖𝘷𝘦𝘳 𝘈𝘣𝘴𝘦𝘯𝘵 𝘋𝘦𝘧𝘦𝘯𝘥𝘢𝘯𝘵𝘴 on 23 May 2024. During this lecture, Prof Yeo considered the historical backdrop to the current law in Singapore on when overseas defendants may be subject to the in personamjurisdiction of the court, with a view to understanding the old and new issues arising from the overhaul of the rules for service out of jurisdiction in 2021 and the amendments in 2023 to accommodate the Hague Service Convention. Prof Yeo also considered the future-readiness of these rules. We thank Prof Yeo for sharing his valuable insights on this topic. In the field of law, there exists a principle known as "Audi alteram partem." This Latin phrase translates to "listen to the other side," emphasizing the importance of considering all perspectives before making a judgment. By adhering to this principle, one can avoid hasty conclusions and potentially regrettable mistakes. This principle holds true not only in legal matters but also in our everyday lives. It serves as a reminder to not solely rely on one source of information, as doing so can lead to misinformation and misinterpretation. Instead, it is crucial to conduct thorough research and gather all relevant facts before reaching a conclusion. In essence, the principle of "Audi alteram partem" underscores the significance of being open-minded, objective, and diligent in our decision-making processes. By embracing this principle, we can strive towards making informed and fair judgments in all aspects of our lives. #Audialtrempartem #william #latvia

📕 New Public Scientific Article on Judiciary by ALF Members! 📕 👉 ALF members Bojan Spaić and Mila Djordjevic have published an article titled "Who Works More, And Who Works Smarter? Comparing Judicial Performance in Europe" in Pravni Zapisi 1/2024. This is their second article on judicial efficiency, comparing CEPEJ data for six European countries: Serbia, Slovenia, Croatia, France, Austria, and Norway. ✏️ The authors conclude that in 2020, Serbian judges resolved more cases across all instances compared to their counterparts in the other countries studied. However, they also fell short of the caseload standards set by Serbian law. The study found significant discrepancies in the performance of Serbian courts, but this did not impact the evaluation of judges, as 485 out of 505 evaluated judges received the rating "exceptionally successfully performs the function of judge" for the year 2020. 📌 The article is available at this link: https://lnkd.in/dTJ7E5Q6

🚀 Big News Alert! 🚀 I'm beyond excited to share that my latest research has been PUBLISHED! 📚✨ 📄 Title: "A jogcímhez kötöttség elvének érvényesülése az új Pp.-ben – az ítélet dolog kifogása és az elévülés tükrében" (The Principle of Legal Title Adherence in the New Code of Civil Procedure – Through the Lens of Res Judicata and Limitation) 💡 What’s it about? This study dives into the new Hungarian civil procedural rules, exploring how sticking to specific legal titles impacts: ⚖️ Litigation predictability 🔄 Judicial fairness ⏳ Limitation periods … and the double-edged sword this principle creates between procedural efficiency and substantive justice. 🌟 Why it matters? It sheds light on how this legal innovation can reshape our courts, but also raise challenges for equitable resolution. 📥 Check it out here: https://lnkd.in/dP8wSzch 💬 I’d love to hear your thoughts!
