In Ontario, there are key distinctions between common law relationships and legally married relationships. 👫 Common Law Partners are considered as such after: ● Living together in a conjugal relationship for at least three years, or ● Having a child together and living together for one year. Married Spouses have access to property division under the Family Law Act, which may entitle one party to an equalization payment. Common law spouses, however, are not entitled to the same property division system and only retain legal ownership of assets in their name. Need clarity on your relationship status and rights? Q: I’m getting married this Spring, is it too late for me to make a Pre-Nup? A: Pre-Nuptial Agreements are a great way of offering protection, clarity and peace of mind. They must be made at least 28 days before the big day, however, sooner is better to allow time for your partner to seek their own independent legal advice. If you are getting married soon and would like to explore making a Pre-Nup, please get in touch with our experienced Family Law Team. #PreNuptialAgreement #PreNup #FamilyLaw #FamilySolicitor https://bit.ly/4cIfFgQ

While the rights of de facto couples are very similar to the rights of married couples, there are some important differences. If you need advice, or want to understand what you are entitled to in the event of a separation, it’s best to speak to a family lawyer. Continuing our break-down of new family law legislation that went into effect July 1, per a study conducted by the Virginia Family Law Coalition, interlocutory appeals are not to be permitted as a matter of course in domestic relations cases. They recommend that the statute be amended to clarify that the prohibition would not operate to negate Virginia Code § 8.01-675.5, which allows a circuit court to certify an order for interlocutory appeal.
