On April 24, 2024, President Biden signed into law an emergency supplemental appropriations law that provides substantial military aid to Ukraine, Israel, and Taiwan and could force the sale of TikTok. The bill includes an expansion of the statute of limitations applicable to civil and criminal violations of U.S. sanctions laws, allowing the U.S. government to impose civil and criminal penalties for up to ten years following a violation of sanctions programs administered by the Office of Foreign Assets Control. On April 24, 2024, President Biden signed into law a 110-page legislative package that extended the statute of limitations for violations of IEEPA and TWEA; provided military aid for Ukraine, Israel and Taiwan; set the stage for the banning of TikTok, and provided authorities for the eventual confiscation of Russian government assets. Less reported on are the whopping 37 new “secondary sanctions” and other targeting criteria imposed through eight different statutes within the legislation, almost all most which are effective immediately, even though OFAC will likely not implement them in regulations or provide guidance on them for some time.
