This post focuses on four examples of the problems and barriers created by humans in government, and the corresponding opportunity to considerably improve access to justice by improving policy in those areas. Addressing these policy issues won’t remove the need for other access to justice interventions but can materially improve the landscape to maximize their impact, and as a legal community, we need to lead the way on the solutions. https://lnkd.in/g8BYec5Q

3_10_24 My neighbour almost blocked my ears 😮💨😮💨🤧 ----------------------------------------------------------- 🌸Understanding Public Nuisance under the Law of Torts Today, let’s focus on a legal concept that affects not just individuals, but entire communities: Public Nuisance. Picture this: one of my neighbors decided to take up playing the trumpet—not a well-played one, mind you—and it was loud, constant, and disruptive to everyone in the neighborhood. It wasn’t just an inconvenience for me, but for the entire community. This is a perfect example of what we call public nuisance in legal terms. In tort law, public nuisance refers to any act or omission that interferes with the public’s reasonable comfort and convenience. It's not just about private annoyances but disturbances that impact a wider section of the community. Common examples of public nuisance include: 🌱Obstruction of public roads or highways, 🌱Pollution of air or water sources, 🌱Excessive noise from construction or other activities, and in my case, musical misadventures! An important point to note is that, in cases of public nuisance, the Attorney General (AG) of the state or the Federation has the power to bring a lawsuit on behalf of the public, as it affects public rights and not just private individuals. This means that when a nuisance impacts the general public, the AG can step in to ensure that justice is served and that the nuisance is stopped. In Nigerian law, public nuisance is actionable because it affects public rights. For instance, the CRIMINAL CODE (Section 234) addresses offenses related to public nuisance, which can result in *fines or even imprisonment*. This is why it's so important to balance personal freedoms with respect for the wider community’s comfort and rights. Once again, a big thanks to Favour Atoyebi for inspiring me to take on this challenge and consistently discuss legal concepts. and don't forget to stay tuned for what is to come. Don't forget to like, follow , and connect for more educational contents.🤗🌸 ___________________________________________ I'm still Aliyah Wahab, do well to connect with me for more insights into law of torts and professional development. ⚖️ #30dayschallenge #ConsistencyIsKey #Growthmindset #PublicNuisance #LegalEducation #LawOfTorts
