Should retribution be understood solely as punishment? Should victim participation be framed in an adversarial manner? Should we understand our justice reaction as somehow a return to a previous state? If you are interested in the answers Alice Bosma and I have to offer to these questions, check out the paper Legal Fictions in Various Forms of Victim Participation in the journal International Criminology, see https://lnkd.in/eXDNiCxD Drawing on the philosophy of As If from Hans Vaihinger, the more general questions are: with which legal fictions are victims confronted in justice processes, and to what extent are they useful? Curious to hear what you think!

The Australian Institute of Criminology's recent review of child sexual abuse and sexual assault legislation has highlighted both consistent and inconsistent protections across Australia. Whilst jurisdictions align on criminalising sexual conduct, the review identifies crucial areas where protections vary, particularly in consent laws and reporting obligations. These findings underscore the need for a stronger, unified approach to justice. With expertise in navigating complex legal frameworks, we are committed to offering clients informed representation in these critical areas. #JusticeReform #ProtectSurvivors #CriminalJustice Disclaimer: All advice provided by Whitehall and Associates is for general and educational purposes only and we urge everyone to seek expert legal advice and guidance regarding all aspects of our content.

In a first study of its kind, the Australian Institute of Criminology reports the first estimate of the prevalence of recorded family and domestic violence offending in a population sample in Australia. Dr Rick Brown, deputy director of the Australian Institute of Criminology says “it is an important step towards increasing the visibility of family and domestic violence perpetrators”. In this study, they’ve used criminal history data for three birth cohorts in New South Wales to estimate the prevalence of recorded family and domestic violence offending. WCS presents some of the findings. #dfvawareness #dfvprevention #womenscommunitysheltersau
