"In defence of fundamental rights and public liberties in Europe: A radically democratic plea from a legal perspective We find ourselves at a crucial moment for the defence of democratic principles and fundamental rights in Europe. The recent actions by German authorities, such as the prohibition of the Palestine Congress, the denial of entry to DiEM25 co-founder Yanis Varoufakis, and the detention and expulsion of Dr. Ghassan Abu Sittah, are clear indications of a concerning decline in respect for human rights and public liberties within the European Union (EU). In this plea, we aim to address these violations from a radically democratic and legal perspective, delving into European jurisprudential doctrine and relevant legislation, in order to urgently call for action in defence of democracy and fundamental rights in Europe."

The open letter #EUCivicSpaceNow, initiated by Civil Society Europe (CSE) and backed by 415 civil society organisations —from 26 Member States and 4 EU candidate countries— is addressed to the upcoming Polish, Danish, and Cypriot Presidencies of the Council of the European Union, as well as the Presidents of the European Commission and the European Parliament. The letter outlines concrete actions to promote democracy, enable, support and protect civil society, strengthen civil dialogue and protect human rights amid growing concerns over the erosion of democracy in the EU. 🔹 The protection of political and civil rights and freedoms is an integral element of the democratic infrastructure of a country. Such protection is of paramount importance in the context of European integration path Ukraine has undertaken. 🗣 This was stated by Oksana Tsymbrivska, Team Leader of EU Project Pravo-Justice at the VII International Scientific and Practical Conference "Administrative Justice in Ukraine: Theoretical and Practical Challenges" on the topic "Judicial Protection of Political and Civil Rights and Freedoms in Before the War, During Wartime and After the War". 🔸 She emphasised that negotiations on Ukraine's accession to the EU require much work to align national legislation with the acquis communautaire. 💬 "Justice matters are included in the First Cluster of EU Membership Negotiations – the so-called fundamentals cluster. It is the first to be opened and the last to be closed. Therefore, strengthening the rule of law as one of the main criteria for joining the EU is an absolute condition for completing the negotiation process for Ukraine," said Oksana Tsymbrivska. 🔹 She also stressed that the process of approximating Ukrainian legislation to EU law is impossible without regard to the interpretation by the Court of Justice of the European Union. 💬 "It is the ability and willingness of Ukrainian judges to apply the interpretive jurisprudence of the EU Court of Justice that will determine, among other things, the success of negotiations for Ukraine and their duration," said Oksana Tsymbrivska. 🔸 Moreover, she noted that along with the alignment of national legislation with the acquis communautaire, one of the most important tasks for Ukrainian society will be to transform values and behavioural patterns stemming from them to the values of the EU. 💬 "It is crucial to understand this because the EU is not merely a single market. Excellent analysis on the key findings of the International Court of Justice (ICJ) ‘s advisory opinion on the legal status of the occupied Palestinian territory and its implications for the realization of Palestinian rights. “The ICJ's opinion on the legal consequences of its finding that the Israel occupation is illegal, while expressed in generalities, will undoubtedly put wind in the sails of those movements and states seeking to increase the cost on Israel for its serial violations of international law and for denying Palestinian self-determination. Weapons sales will be targeted. The call for divestments from Israeli companies will grow. Trade agreements with Israel will be re-examined, particularly respecting the import of settlement goods and services. There will be a push to re-establish the U.N. Special Committee Against Apartheid. BDS campaigns and student protests will expand. The pressure from civil society and states on the chief prosecutor of the International Criminal Court to expand his investigations into war crimes arising from the Israeli occupation—and particularly the Israeli settlements—will only increase. On July 9, 2024, at the UN in Geneva took place an important Side-event about the Human Rights violations of Azerbaijian, having Bakou committed an ethnic cleansing against Nagorno Karabakh Armenians since December 12, 2022. A delegation of the Commission for the Defense of the Fundamental Rights of Nagorno Karabakh Armenians, headed by Vartan Oskanian (former Foreign Minister of Armenia) Armine Alexanian (former Vice Foreign Minister of Nagorno Karabakh) and Karnig Kerkonian (International lawyer) explained in front of a very attentive audience what follows: The keys to peace between Armenia and Azerbaijan involve several critical measures: Right of return: Armenians displaced from Nagorno Karabakh must be allowed to return under international protection, ensuring their safety and democratic self-governance. This principle is essential for any peace agreement and sustainable peace. Release of Hostages: Azerbaijan must release all Armenian hostages, including soldiers, civilians, and former Nagorno Karabakh officials. Sustainable peace requires resolving the hostage situation and addressing past crimes through a neutral international mechanism. Protection of Cultural Heritage: Armenian cultural and religious sites in Nagorno Karabakh must be preserved. International efforts to protect these sites would build confidence and contribute to lasting peace. International Oversight: Establish a transitional UN administration and peacekeeping force in Nagorno Karabakh to ensure the security and right of return for ethnic Armenians. This should include appointing a UN rapporteur and creating a fact-finding mission to document the situation. Humanitarian Aid: Provide urgent humanitarian assistance to Nagorno Karabakh refugees in Armenia to alleviate their immediate needs and support their resettlement. Ensuring these measures can address human rights violations, build trust, and lay the groundwork for a lasting peace between Armenia and Azerbaijan.

Last week saw probably the biggest conference on fundamental rights and democracy in Europe this year - Fundamental Rights Forum organised by European Union Agency for Fundamental Rights. For me, it was not only an opportunity to once again meet great friends from the RARE programme (run by the Hertie School and the Hungarian Helsinki Committee) - proof in the picture 😊 😎 💪 - but also a chance to listen to some smart people at such an important moment for the whole of Europe, ahead of the upcoming elections. 🗳 As a result, I brought home quite a few interesting observations, including ➡ remarks by two Ministers of Justice - the Austrian Alma Zadić and the Polish Adam Bodnar - talking about countering the deepening lack of trust of citizens in public institutions and moving away from neo-authoritarian and anti-constitutional government using ways that are compliant with the Constitution, ➡ Balazs Denes of Civil Liberties on how to talk about human rights and civic organisations in a language that reaches out to people, referring to their everyday needs, or ➡ Márta Pardavi of the Hungarian Helsinki Committee pointing out that the voice of civil society organisations should be put at the centre of further debates about the European Union and their members given adequate protection from threats in all Member States...
