Are you prepared for the new law on tips? Here's an insight into what you will need to know. Employers must pass on tips to workers without any deductions. A draft statutory code of practice sets out how tips should be distributed in order to demonstrate fairness and transparency. Employers should have a written policy on tips and record how they manage tips. Workers will have rights to request information about an employer’s tipping record – this will allow them to bring credible claims to an Employment Tribunal. The legislation will apply to hospitality businesses, including restaurants, bars, and cafes. Tips must be allocated fairly between all workers, including those on zero-hour contracts. The rules are due to come into effect on 1 July 2024 in England, Scotland, and Wales. Yesterday the government launched the new code of practice for tipping that all businesses will need to follow. The legislation has been pushed back 3 month’s and now comes into effect from the 1st October allowing businesses time to prepare and implement the required changes. #fairtipact #newcodeofpractice

Quite a few new government policies are due to come into effect in early October, including the Employment (Allocation of Tips) Act 2023, which will require employers to share tips, gratuities, and service charges fairly and transparently with their workers. If you run a hospitality business and regularly distribute tips to your staff, you will need to make sure you: • Pay qualifying tips no later than the end of the month after the customer paid them • Keep detailed records of all tips received and distributed • Maintain a written policy for managing and distributing tips, and share this with staff • Allow employees to request access to their tip records, as is now their right Perhaps you’ve already implemented all or some of the above measures, or maybe the Act will force you to adopt an entirely new way of working. The UK govt issued its response this week to its Consultation on the Statutory Code of Practice on Fair and Transparent Distribution of Tips. An updated Code of Practice is also published. The Code and full measures of the Act will come into force on 1 October 2024 when employers will be required to pass tips on to workers and have a tipping policy in place. (Only 50% of respondents to the consultation noted that all tips are currently passed on to staff.) The Code includes practical guidance around criteria businesses might apply to allocate tips fairly. Tips must be paid to staff, at the latest, by the end of the month following the month in which the tips are paid by customers.
