🚨 New Guidance for Letting Agents: Tackling Damp and Mould 🚨 Did you know 41% of rental properties suffer from damp or mould issues? With the upcoming extension of Awaab’s Law to the Private Rented Sector (PRS), it's more important than ever for letting agents, landlords, and tenants to understand how to manage this problem. A recent survey of 719 letting agents revealed that while most agents recognize the seriousness of damp and mould, many still believe it's primarily caused by tenant activities like not using extractor fans or drying clothes indoors. However, 23% of agents reported that landlords are not taking these issues seriously enough. To address this, The Property Ombudsman has released new guidance aimed at: ✅ Helping agents, landlords, and tenants identify the signs of condensation, damp, and mould ✅ Offering tips on prevention ✅ Clarifying how to report issues early It's a vital step in ensuring better, safer living conditions for tenants and avoiding potential legal issues for landlords. The Federal Court's recent decision in Obata and Vignesh has significantly impacted the housing development sector, especially in the context of the landmark Ang Ming Lee case. This ruling clarifies that liquidated ascertained damages (LAD) claims are governed by a six-year limitation period and establishes that the Ang Ming Lee decision will apply only prospectively, not retrospectively.
