Prop 47 is at risk of being rolled back by Prop 36, which will be on the ballot this November (in California). Prop 36 not only threatens to undo Prop 47 but will also introduce new penalties for drug use, various theft offenses, and broad sentencing enhancements that would apply to any type of crime. I recently co-authored an op-ed that appeared in voiceofsandiego.org about Prop 47, highlighting the #facts that support its success. As noted in the op-ed, "Proposition 47 is a public safety measure as well as a legal reform measure. This law has fostered safer communities for everyone by addressing many root causes of involvement in the criminal legal system." Please read it when you have a chance. While I am not versed in the nuances of NC’s RTA process, this article can spark some much needed dialogue for the field. Raise the Age legislation, was developed as a means to address blanket laws and policy, where in some states, led juveniles to become entangled in an adult system. Even those states who have “embraced” RTA still have juveniles, in juvenile facilities, who are moving through an adult system with the appearance of being treated as a juvenile. Systems which are able to evaluate the needs of the individual and develop a plan that addresses the multi-faceted issues that led to incarceration will be far more likely to develop true rehabilitation. Unfortunately, we are often left with these broad-brush strokes intended to correct issues which then leads to overcorrection, again and again. It is refreshing to see juvenile justice in the spotlight but so often it is that overcorrection, the knee-jerk reaction to the actions of a few, which ultimately causes harm to the many. A new proposal for strengthening oversight of the County of San Diego Sheriff's Department would maintain the sheriff's elected status while creating real checks and balances through modest changes to the county's oversight system. Under the proposed reforms, the Citizens' Law Enforcement Review Board (CLERB) would gain the power to appeal rejected recommendations to the County Board of Supervisors for final determination. This change would create a crucial accountability mechanism while respecting the sheriff's electoral mandate. The proposal also calls for creating an Inspector General position to serve as permanent counsel to CLERB, providing professional expertise and continuity to the civilian board's work. The IG would bring investigative experience and institutional knowledge to CLERB's deliberations, while helping craft more effective recommendations. Similar positions have proven successful in other jurisdictions. These changes would require relatively modest amendments to the county charter, making them more politically feasible than wholesale restructuring, The key is creating accountability without undermining the democratic process of an elected sheriff. The Board of Supervisors could consider placing such charter amendments on the ballot as early as 2025.

The lawsuit filed by the ACLU and HSSK challenging Connecticut’s pay-to-stay law has been resolved, but not before it resulted in major reforms protecting the financial rights of formerly incarcerated individuals. Key outcomes from the case include: ➡ In response to the filing of the action, the state amended the carceral lien statute to exempt all civil recoveries and $50,000 of a former inmate’s assets from collection by the state. ➡ The state agreed to withdraw its liens and collection efforts against the inheritances of the three named plaintiffs. Because the court determined that assessing what constitutes an excessive fine under the United States Constitution requires assessing each individual’s circumstances, the resolution was limited to the three plaintiffs rather than more broadly to similarly situated individuals. This is a significant step forward for justice and financial security for those impacted by incarceration in Connecticut! #JusticeReform #ACLU #FairnessForAll #probono #Connecticut
