Fingers crossed the Corporate Transparency Act gets canned! What garbage legislation. First off, it is a violation of privacy. Second, the IRS has most of this information already through tax returns. Third, it places an undue burden on small businesses, while big businesses are exempt. What small business owner is going to remember to update his beneficial owner register information if they move or get a new driver's license? Small businesses don't have the required infrastructure to ensure compliance. The result is that small businesses will pay the bulk of the fines for failing to comply. Adify, LLC d/b/a EMPLOYEE.CREDIT ("EC") was busy again in NY this week. From 2/7/24 - 2/9/24, I count at least 8? complaints filed requesting judgment for payments of fees for #ERC work. A quick look at all of the complaints and their attached engagement agreements doesn't necessarily reveal any big shockers. You see a range of percentages charged--10%/12%/20%, etc., -- perhaps an interesting variation in a couple of the agreements as to how those would be calculated.
