How does the EU’s AI Act allocate responsibilities in respect of AI systems? The specific obligations of an organisation under the AI Act depend on: (a) the role of that organisation in relation to the relevant AI system (e.g., are they a provider or deployer); and (b) the AI Act’s categorisation of the relevant AI system. The AI Act categorises AI systems based on their potential risks and divides them into different categories depending on the data they capture and the decisions or actions taken with that data. The EU Artificial Intelligence Act is the world's first comprehensive AI legal framework requiring companies to classify their AI according to risk categories. Under the EU Artificial Intelligence Act, the onus of accountability for AI classification shifts significantly to companies. They are no longer allowed to disclaim responsibility for manipulative or prohibited AI practices, such as social scoring. Instead, they are expected to take proactive measures to eliminate such activities. This act is a fundamental change for technology and businesses.
