The European Union Deforestation Regulation (EUDR) has brought up intense discussions about climate change and environmental preservation. One of the main points of attention was the impact of the EUDR on biomes that do not fit the definition of “forest” established by the United Nations (UN). Due to the complexity of the issue, the implementation of the EUDR has been postponed: instead of taking effect on January 1, 2025, it will be applied from January 1, 2026. This postponement gives developing countries — that most opposed the original conditions of the EUDR — more time to adopt strategic measures that, among other acts, reduce the negative impacts of the regulation on other biomes. For this article, I had the privilege of interviewing renowned specialists from institutions such as Ipam, Ipea, Greenpeace, and Business Law Partners alongside my partners Allan Batista, Fernanda Rossini, and Flávia Fernandes. The European Parliament on Thursday voted in favour of delaying the bloc’s deforestation regulation (EUDR) to give companies more time to comply. The vote – which experienced some technical issues – saw the Parliament agree to the 12-month delay put forward by the European Commission in October with 371 votes to 240 and 30 abstentions. It also voted in favour of other amendments. A spokesperson for the European Parliament told Responsible Investor that there is no timeline for the trilogue discussions, as the Council of the European Union will first have to take a position on the amendments. They added the last opportunity for the Parliament to adopt the regulation is mid-December and that trilogues must happen prior to that. #EUDR #deforestation #EU https://lnkd.in/endUX_Wt

🌿 On 14 November 2024, the European Parliament voted in favour of the Commission's proposal to delay application of the EU Deforestation Regulation by one year. The Parliament also voted in favour of a number of other amendments to the EUDR including creation of a new category of countries posing “no risk” on deforestation. The additional amendments to the EUDR were not originally proposed by the Commission and the Council had already agreed to the one-year delay without suggesting any other amendments. The Parliament and Council will now need to enter into negotiations over the new amendments in the hope of reaching final agreement before the end of the year. #breakingnews 🌳 This morning the European Parliament resolved to postpone the entry into force of the EU Deforestation Regulation, following the proposal made by the European Commission beginning of October. ➡ For large operators and traders, relevant obligations will apply starting from December 30, 2025. ➡ Small and micro-enterprises will have six additional months (i.e., until June 30, 2026). 🌲 This long-awaited postponement will help ensuring a better implementation of relevant obligations, also in light of the updated guidance published by the EU Commission in October. 🌴 The Parliament also adopted other amendments, including the creation of a new category of countries posing “no risk” on deforestation, which would require significantly less stringent obligations by corporations. EUDR Negotiations Conclude with Consensus Between the Council and EU Parliament The second round of negotiations on amendments to the EU Deforestation Regulation (EUDR) concluded on Tuesday (December 3rd) with a consensus reached between the Council and the European Parliament. Key developments: The EPP withdrew its proposals for additional changes, such as the introduction of "no-risk countries" for global deforestation (refer to my earlier post for details: https://lnkd.in/e3igfhVA). This withdrawal, combined with the agreement on a 12-month delay to the applicability of the regulation, likely paved the way for the consensus. What’s Next? The informal agreement between the co-legislators will be put to a vote during Parliament’s next plenary session, scheduled for 16–19 December. For the delay to take effect, the text must be formally endorsed by both the Parliament and the Council and published in the Official Journal of the EU by the end of the year. #EUDR #InternationalTrade #Deforestation #Sustainability
