So, what is international arbitration? 🤔 🌐 It's a formal, binding process for resolving disputes. It is more similar to litigation than mediation (it does not require parties to agree an outcome). But the dispute is decided by an independent arbitrator or a panel of arbitrators, instead of judges in a national court. While national courts may play a supportive role, if needed, the issues in dispute are decided by the arbitrator(s), and their decision is binding. Why do businesses prefer arbitration over litigation? 🏢💼 There's not a one-size-fits-all, and dispute resolution provisions should never be treated as boilerplate. But arbitration can offer a neutral forum for resolving disputes, more autonomy for the parties, procedural flexibility, privacy, specialist decision-makers, potential confidentiality and easier cross-border enforcement of decisions. For disputes arising from international commercial relationships, arbitration is very popular. It is well-suited to the complexities of cross-border transactions and avoids some of the challenges that can arise when litigating disputes in national courts.
