Crimes at sea come in different shapes and colors. Sometimes, some of these will be construed as political events. Take the licensing of Chinese vessels in Senegal some 3 years ago, which was denounced by Greenpeace West Africa. The licensing defied the rules and was construed as illegal the same way in 2012, the licencing of Russian ships was construed as illegal. Piracy is an easy one. It is illegal. The Houthis highjacking ships was subject to debate. Now, this. As an expert, there is no debate. This is a crime. Shooting at fishermen fishing within THEIR OWN waters by a “foreign” occupying army IS illegal and should be sanctioned. No matter where we stand, this is a crime.

The Abloads sector has been regulatory under-enforced for decades, this has allowed poor practice by operators and enforcement agencies alike. From over loading to under notifying, some less professional operators have given the client false expectations, the days of “call today for delivery tomorrow” are no more. Abloads legislation is extremely complex, and as such some regulatory agencies have, and do get it wrong! Even more frustrating is the inconstancy and disproportionate enforcement seen throughout the UKs 43 Police forces. Recently, Police forces across the country have changed their approach to enforcement of all Abloads, this is in two key aspects of a movement. One; blanket embargos (or the time at which an Abload may move) Two; the flat refusal to accept short notice notifications and or restriction of the date range for the movement. These both transpire into an unsustainable financial burden to our members, from unnecessary admin, well-being of drivers and reduction in revenue, add in delays to major infrastructure projects, including renewables and UK PLc, one must ask what is being achieved by the Police? Abloads are not high risk, the data shows this. The salient question is: Is this increased enforcement across the country a credible use of scarce Police resources? Indeed, there is even a question whether some of these changes are even lawful, specifically insisting on Police escorting under SPS rules and refusing a lawfully submitted notification! Whilst we would all support the move towards ensuring that all Abloads are safe, legal, and compliant, one must consider the proportionality of the recent change to enforcement. Abloads are green too, it makes sense to move one heavy truck, rather than multiple lighter ones, this reduces CO2 emissions as well as reducing congestion. This is a key area of the mobile crane sector. Operator members of Abload (STGO) vehicles pay the highest road excise duty there it is, therefore, infuriatingly frustrating that members are denied access to roads and movement of their client goods with, it seems, no good reason.
