We are rebuilding for our new contract which started last week. Learned many lessons in the past five months about this industry. We won’t make the same mistakes twice. New Employment Contract Law set out by the Labour Government today is going to hurt Traffic Management immensely as the Agencies will now hold the keys to the Industry. Under Dutch law, it is possible to conclude a fixed-term employment agreement that ends by operation of law and thus does not require the employer to give notice for the employment agreement to end. However, this does not mean that the employer is free from any obligations if a fixed-term employment agreement is about to expire. Failing to meet the notifying obligation comes with various risks. Therefore, below we have outlined four mistakes to avoid when notifying the employee in case of an expiring fixed-term employment agreement. The High Court’s decisions in Personnel Contracting and Jamsek have underscored the significance of the contractor agreements between parties, marking a shift from the previously applied multifactorial test to emphasising the contractual relationship’s primacy. These High Court rulings underscored the critical importance of meticulously drafted contracts for workers classified as independent contractors.
