Employment and Labour law decisions are increasingly emphasizing the need for procedural fairness. Gone are the "good old days" ( I have heard people refer to them as that) of the employment discipline "ambush" where a respondent employee is not given advance notice of the details of the allegations made against them. Here are some key areas of procedural fairness that need to be followed if an administrative investigation is to withstand legal scrutiny: In the context of employment and labour law in Canada, the principles of natural justice and procedural fairness are crucial to ensuring fair treatment in workplace disputes and disciplinary actions. Notice: Employees must be given adequate notice of any disciplinary actions or termination, including the reasons for such actions. Disclosure: Employers must disclose all evidence and information that will be used in making a decision about the employee. Opportunity to Present One’s Case: Employees should have the chance to present their side of the story, including any evidence or arguments in their defense. Opportunity to Respond: If new evidence arises during the process, employees must be given the opportunity to respond to it. Impartial Decision-Maker: The person or panel making the decision must be impartial and free from bias. Right to Representation: Employees often have the right to be represented by a union representative or legal counsel during disciplinary proceedings. Support persons are best to be accommodated as well. These principles help ensure that employment decisions are made fairly and transparently, protecting the rights of employees and maintaining trust in the workplace. Since the "Marentette" decision, Veritas Solutions investigations are now considering evidence possibly produced to discredit the complainant, and giving them an opportunity to respond. Investigations that could result in termination of employment, Human Rights complaints, Health and Safety complaints, legal or media (or social media) exposure must be conducted in a fair, transparent, and unbiased manner. High risk investigations such as the above require training and experience. The ability to withstand a high level of legal and public scrutiny should be the standard in which to approach a serious administrative investigation. It begins with procedural fairness. These are some of the concepts taught in our Workplace Investigations Training workshops in our partnerships with CPHR Alberta, CPHR Saskatchewan, CPHR BC & Yukon and CPHR Manitoba
