Karen Tan, chief strategy officer at Maxwell Chambers and co-chair of the Institutions Task Force, had this to say, “The launch of the Green Survey feels particularly timely as it represents a pivotal step in understanding the evolving role of arbitral institutions in promoting sustainability. By gathering insights from institutions globally, we can tailor support mechanisms and ensure that the Campaign’s efforts are informed, strategic and impactful in driving sustainable practices forward.” The Green Survey is open to organisations that offer case management; hearing facilities; and/or training and events. Ecojustice lawyer Fraser Thomson joined legal voices from around the world on the impact of the European Court of Human Rights ruling that declared governments inaction on emissions as a human rights violation, sharing: “European courts have been a guiding light for judges around the world in recognizing that the climate crisis is a human rights crisis and that it is only through government action that we can preserve a livable future. In Canada, courts at every level, including our Supreme Court, have looked to European courts when weighing how the legal system ought to respond to the climate crisis. Today’s landmark ruling will undoubtedly continue this trend and assist courts around the world in addressing this existential threat to life on our planet. Last Wednesday, ERCST presented its paper ‘Green Claims’ Frameworks – A Comparative Look at Recent Developments in EU and Non-EU Jurisdictions. The aim of the present analysis is to look at and take stock of several legal regimes addressing the substantiation of voluntary explicit environmental claims, focusing on climate-related claims, and see how the EU legal framework compares and fits within the international context and among some developments in other non-EU jurisdictions (i.e., UK, US, Australia, and Canada). CGA Institutions Task Force launch global survey for arbitral institutions The Institutions Task Force of the Campaign for Greener Arbitrations has launched a survey for arbitration institutions worldwide (Green Survey) aimed at identifying: (i) the level of awareness and engagement on sustainability; and (ii) the challenges institutions face in adopting and encouraging more sustainable behaviour. Through the Green Survey, the Task Force aims to gather data that will inform its strategies to better assist arbitration institutions to embrace greener practices. The Survey is open to organisations that offer any of the following: (i) case management; (ii) hearing facilities; and/or (iii) training and events. This Survey will remain open until 15 June 2024.
