The Ministry of Environment, Forest and Climate has introduced the E-Waste (Management) Amendment Rules, 2024, to amend the existing E-Waste (Management) Rules, 2022. The key highlights of the amendment include: 1. Granting the Central Government the authority to extend the filing period for returns or reports under the Rules by an additional 9 months. 2. Revising the definition of "dismantler" to align with guidelines from the Central Pollution Control Board, removing the previous requirement for authorization from State Pollution Control Boards. 3. Introducing provisions for the transaction of Extended Producer Responsibility (EPR) certificates, allowing the Central Government to establish platforms for their exchange or transfer according to CPCB guidelines. 4. Assigning the Central Pollution Control Board the responsibility to set the highest and lowest prices for EPR certificate exchange, equal to 100% and 30% respectively of the environmental compensation for non-compliance.

The Ministry of Environment, Forest and Climate Change in its notification dated November 12, 2024 has exempted the all industrial plants from the requirement of obtaining prior approval from the relevant state pollution control boards to establish and operate: (i) having pollution index score up to 20, as listed in the Schedule (LIST OF WHITE CATEGORY OF SECTORS CLASSIFIED BY CPCB FROM TIME TO TIME, AS PER THE 2016 CLASSIFICATION METHODOLOGY); (ii) which have obtained prior environmental clearance as per the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 issued under the Environment (Protection) Act, 1986 (29 of 1986), in respect of previous consent to establish such plant. These permissions are known as ‘Consent to Establish’ and ‘Consent to Operate’. This exemption comes as a relief for the White category industries which are considered to have minimal to negligible potential for pollution and also reduced the burden on the state pollution control boards. #complianceupdate #EC #clearance #MoEFCC

G.S.R. 703(E).––In exercise of power conferred by the proviso to sub-section (1) of section 25 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), the Central Government, in consultation with the Central Pollution Control Board, exempts the following categories of industrial plants from the application of the provisions of the said sub-section, namely:- (a) all industrial plants having pollution index score upto 20 as listed in the Schedule to this notification, subject to condition that such plant shall inform in writing to the State Pollution Control Boards or the Pollution Control Committees; (b) all industrial plants which have obtained prior environmental clearance as per the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 issued under the Environment (Protection) Act, 1986 (29 of 1986), in respect of previous consent to establish such plant.

Notification: Exempts Industries from Dual Approvals (EC+CTE= Only EC) Ministry of Environment, Forest and Climate Change Issues Gazette The Government of India has accepted long-standing demand of industry to remove dual compliance of Environmental Clearance (EC) and Consent to Establish (CTE) for setting up of new industries. Now, non-polluting white category industries will not be required to take CTE or Consent to Operate (CTO) at all. The industries who have taken EC will not be required to take CTE. This will not only reduce compliance burden, but also prevent duplication of approvals. Notifications to this effect have been issued by MoEFCC under the Air Act and Water Act. The notification effectively integrates these two approvals and a Standard of Procedure has also been issued in this regard to take into account the issues considered during CTE process, in the EC itself. State Pollution Control Boards will be consulted during EC process. Further, the CTE fee shall be required to be paid by the industry, so that there is no loss of revenue to the States.

🏭 New Exemptions for Certain Industries 🏭 Ministry of Environment, Forest and Climate Change has issued draft notifications on 19th July 2024 amending the Air (Prevention and Control of Pollution) Act, 1981, and the Water (Prevention and Control of Pollution) Act, 1974. These amendments introduce exemptions for certain categories of industries from the requirement of obtaining prior Consent to Establish (CTE) and Consent to Operate (CTO). 1. Exemption for White Category Industries: The government has introduced exemptions for industries categorized as ‘white’, which are considered low-risk in terms of pollution. These industries are now exempt from the requirement to obtain Consent to Establish (CTE) and Consent to Operate (CTO) under both the Air and Water Acts. 2. Exemption for Industries with Prior Environmental Clearance (EC): A major update is that industries requiring prior EC are now exempt from obtaining Consent to Establish (CTE) under both the Air and Water Acts. This exemption aims to streamline the regulatory process by eliminating the need for duplicate approvals. This means that once an industry has obtained EC, it does not need to separately apply for CTE, as the EC process itself includes a comprehensive environmental assessment and approval of the proposed mitigation measures. Anyone interested in raising objections or making suggestions regarding the proposals in the draft notification may submit their comments in writing within 60 days.
