Agustín G. Sanz and Luis Tamborini write about a first-of-its-kind ruling by an Argentinean court granting the enforcement of an ICSID award in the 3rd edition of the ICC Argentina Arbitration Bulletin. The article discusses a novel ruling by a first instance court on administrative matters affirming the enforcement of an ICSID award against Argentina. The decision, a first step towards the clarification of the enforcement landscape in Argentina, leaves open questions for future courts to settle about the timeframe for judicial intervention and the potential relevance of public policy considerations that were not engaged in this case.   To read the article in Spanish, please click below.

Pedro Zelaya Etchegaray was selected to act as arbitrator for this year's international commercial arbitration case presented at the 21st Vis East Moot in Hong Kong. Nearly 1000 students from around the world will compete to defend the case, which this year is about the use of #IA and. The oral argument phase will take place between March 10 and 17, 2024. In terms of rules, the dispute is submitted to an arbitral tribunal in accordance with the ICC Rules of Arbitration. The fictitious country where the arbitration will be held has enacted the Uncitral Model Law as amended in 2006. At the same time, the four hypothetical states that are or may be involved are parties to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards ("New York Convention"). Enforcement of foregin arbitral awards inside Egypt are regulated by: a. The Egyptian Code of Procedure, especially Articles 297-301, related to the Enforcement of foreign arbitral and judicial rulings. b. Egyptian Arbitration Law No. 27 of 1994, specifically Articles 9, 55, 56, 57, and Article 58. This legal research inculdes the following: 1. Introduction to Arbitration. 2. Definition of the Arbitral Award. 3. Enforcement of foreign arbitral awards and the laws that must be applied. 4. Enforcement of foreign arbitral awards inside Egypt. 5. The Competent Court to enforce the arbitral award and its procedures. 6. The decision of the competent court regarding the application for enforcement of the award and the appeal thereof.
