Want to help with vanishing civil jury trials? If you're a judge, stop having a hair trigger on summary judgment. For all the many judges in my audience. I was listening to a podcast the other day with three former judges, two federal and one state, talking about the declining number of civil jury trials and what could be done about this trend. It was a good podcast. But not once did the issue of summary judgment come up. For non-lawyers, the number of civil jury trials has been on the decline for decades. Lawyers who practice primarily in federal court may go years without a single jury trial. Now, this not all bad. There are many good reasons why it is better for any particular case not to go to trial. Trials are time and resource intensive. And the results are unpredictable. For a an individual party, sometimes a settlement is the best option. A bird in the hand an all. But one reason many meritorious cases never make it to trial at all is that they are winnowed out by a process called summary judgment. If you don't know what summary judgment is, check out my podcast. Briefly, in employment cases summary judgment is usually filed by the defendant company arguing that the court should dismiss the case either in whole or part. The standard is supposed to be whether there is, as to any particular claim, a "genuine issue of material fact." The way it supposed to work is that a court will dismiss a case in which, either by law or fact, a reasonable juror could not find in favor of the non-moving party, usually the employee. In making this determination, a judge is supposed to avoid acting as a jury of one. So, even if the judge personally believes the employee has a loser case, she should deny summary judgment and let the case proceed to trial if a reasonable person could rule in favor of the employee. I wish it worked this way in practice. My firm has lost summary judgment in a number of a cases in which, by my lights, it appeared that the judge basically said, "Nah, I don't like your case. Dismissed." Sour grapes? Maybe. But there has been a lot of ink spilled on this topic, so I don't think that I am alone. What about appeal rights? Yes, an employee who loses summary judgment can appeal the decision, but that process involves an entirely new set of litigation which can take many, many hours of attorney time and many months, if not years, to resolve. May clients decide to pack it in rather than try to climb that mountain, even if he or she has a good case. Note that in state court, judges tend to use summary judgment less frequently, sometimes because summary judgment does not exist under state rules. So, yeah, summary judgment is a good idea in theory, but in practice it sometimes just bars the courthouse doors to plaintiffs with legitimate claims.
