Port Houston Operations Update: USMX – ILA Pending Work Stoppage Thursday, September 26, 2024, 4:10 PM The existing contract between the International Longshoremen’s Association (ILA) and the United States Maritime Alliance (USMX) expires at midnight on Monday, September 30 and we are preparing for a potential work stoppage on October 1st. In the days leading up to September 30th, we expect normal business operations. If there is a work stoppage, Port Houston container terminal gates will be closed. We will provide daily updates and share the latest information on our website as the situation develops. Please see below for additional details regarding our container terminal operations. Friday, September 27 • Standard Hours – 6 am -7 pm, ingate close at 6 pm • No reefers after 5 pm Saturday, September 28 • Extended Hours – 8 am -5 pm, ingate close at 4 pm • No reefers/Out of Gauge • Empty Yards will match our hours • Please confirm LFD/Cutoffs with the SSL • Port Houston Customer Service will be available Monday, September 30 • Standard Hours – 6 am -7 pm, ingate close at 6 pm • No reefers after 5 pm • Vessel ops will conclude by 7 pm Reefer Units: Reefers may be received until 5 pm September 30th,. All reefer units will remain connected to power throughout any work stoppage – Please contact the ocean carriers for monitoring capabilities. Hazardous Units: Hazardous may be received until 6 pm September 30th,. Please ensure the unit is pre-advised before returning to the terminal to avoid delays. Rail: There will be no train departures after September 29th. Storage: Port Houston will not charge the ocean carriers storage on days the terminal gates are closed. Please reach out to the ocean carrier directly for free-time inquiries. General Cargo/Multipurpose Facilities: ILA-supported public general cargo/multi-purpose facilities are expected to be impacted by the work stoppage.

Here's are few below; Owners' Protective Agents: Appointed by vessel owners to protect their interests, these agents ensure necessary services and supplies, monitor service providers, and represent owners in negotiations. Charterers' Agents: Appointed by charterers, they coordinate loading and unloading operations, ensure necessary supplies, represent charterers in negotiations, and monitor service providers. Buyers' Agents: Appointed by cargo buyers, they coordinate cargo discharge, ensure safe and efficient discharge, represent buyers in negotiations, and monitor service providers. Husbandry Agents: Responsible for coordinating services and supplies for the vessel and crew, they arrange bunkering and provisions, coordinate crew changes, arrange waste disposal, and handle documentation. Overall, these agents play a crucial role in ensuring the smooth operation of vessel calls at ports, coordinating services, supplies, and administrative tasks to ensure the interests of all parties are protected and operations are conducted efficiently.

Contracts and market trends for vessel hire: part 2/3 Exploring Risk Allocation in Maritime Contracts – General Average and Beyond Beyond Incoterms, maritime contracts often include additional provisions to address specific scenarios, such as emergencies or shared risks during transportation. One of the most critical concepts in maritime law is General Average, a principle designed to allocate risks and costs among all parties involved in a voyage. This centuries-old practice continues to be relevant in modern shipping and requires a thorough understanding by charterers, shipowners, and cargo owners alike. General Average arises when an extraordinary sacrifice or expense is voluntarily incurred to save the vessel, cargo, or crew from a common peril. For example, if cargo must be jettisoned during a storm to stabilize the vessel, the resulting loss is shared proportionately by all parties with a vested interest in the voyage, including the shipowner and other cargo owners. This principle ensures fairness and financial security for all parties during unforeseen emergencies. In addition to General Average, chartering agreements often include clauses that address specific risks and responsibilities. For instance, laytime and demurrage clauses regulate the time allowed for loading and unloading cargo. If the agreed-upon laytime is exceeded, demurrage charges are applied, compensating the shipowner for delays. Many things people do not understand is the process of Freight Forwarding. The amount of people involved with the loading and movement of the truck from a warehouse to the final mile is more than just a quick act of filling a container or straight truck with cargo and then driving to the final location and unloading the goods to the customer. Planning, calculations, appointment settings, and costs are just small, but major parts to the goal. People often forget about stacking, height restrictions, tare weight, max loads, bracing, and most of all routing. The driver may get the violation but the costs are passed along the supply chain if the load was deemed unsafe by an authority such as DOT/State Police, or local law enforcement. During my last few years in SoCal I was an M&R Superintendent. My role involved not only managing the IAM but ensuring that all the necessary pieces or parts and equipment from tail lights, recapped tires, chassis replacement gear, and more were not only available but functional for each driver to pass the regulations to be on the public roads. Even then I had just scratched the surface of what it takes to get the truck out of the terminal and to the consignee. This experience does put me at a huge advantage over a Freight Forwarder with just the after-terminal experience or from a station to the consignee. Not to mention that during my younger college years I was fortunate enough to get a taste of driving for a dairy warehouse. If you are looking for an experienced Freight Forwarder that also clears Customs and answers emails along with phone calls, not to mention I do not have a VOC phone tree let me know.
