IS A CARAVAN THAT FLOATS ON WATER STILL A CARAVAN? This was an issue at the heart of this case. The Court found that just because a mobile home happens to be floating on a lake instead of stationed on dry land does not mean that the occupant does not benefit from the protection that would otherwise be afforded to mobile homes where it is their main or sole residence (see para 26 of the judgment). The Court did however emphasise that in this case this was in light of the fact that there was a retrospective permission, at para 37: "The reality is that what is described in the permission as a "houseboat" (which is not a term of art) is not what someone might immediately associate with that label, namely the sort of vessel which is commonly found moored in rivers and canals. This "houseboat" is not a boat or vessel of any description. Instead the expression is used to describe what was already there on the land at the time that permission was granted, namely, a statutory caravan which sat on a float which its inventor had explained in the patent application was the means of converting a caravan into a houseboat – as the application put it, a house on water rather than a house on land." This is significant, insofar as it suggests that in granting a retrospective planning permission, regard is had to what was being approved on the ground at the time as an aide to the interpretation of the permission (supported by para 39). The Court also provided a helpful reminder about the interaction between the description of development and relevant conditions at para 32: 32. The grant of a planning permission identifies what is permitted, so far as the use of land is concerned. The scope of the permitted use of the land is defined by the grant. The use specified in the grant may be of a general nature, e.g. "agricultural" or "retail", or it may be limited to a particular function, e.g. "a restaurant". Any conditions attached to the grant of permission will specify what is not permitted, but they will qualify or limit the permitted use, whose scope is delineated by the grant itself. So, for example, the grant may be for a "restaurant" and a condition may specify that the opening hours are to be between 12 noon and 11 pm. n.b. This judgment does not suggest that driving caravans into lakes is a sensible endeavour for the avoidance of doubt.

Why not? The basic definition of a caravan in the 1960 Act is any structure designed or adapted for human habitation which is capable of being moved from one place to another, whether by being towed, or by being transported on a motor vehicle or trailer. Land in a planning context can include land covered by water, the land is the banks and bed of the body of water (as in Thames Heliport Plc v Tower Hamlets).

A Fish Tale: In the brisk air of Seattle, a group of seasoned architect-anglers, set out to design the pinnacle of buildings—a shining salmon in a sea of trouts. With their gear ready, they mapped out an expedition that relied heavily on their tried-and-true fishing spots and techniques, sure that their experience alone would net them the prize catch. However, the meticulously-crafted plan allowed little room for the boat crew (engineers) who might know a thing or two about the currents and undercurrents of fishing (building systems design). Under the constraints of a tight budget and an even tighter schedule, they hired the most affordable engineering crew they could find, as if choosing the least expensive fishing gear when targeting the most elusive fish. The design was swiftly baited and cast into the waters before the engineering crew could check if the equipment was suitable for the turbulent waters of Seattle’s building codes. Then, as the construction documents sailed through the permitting process, akin to casting nets in hopeful waters, the city dockmaster threw a wrench into their smooth sailing: compliance with the 2021 Seattle codes, akin to needing a specific fishing license they hadn’t thought to obtain. This oversight required the hiring of a third-party consultant to perform a gap analysis, much like calling in a seasoned fish spotter to identify what had been missed beneath the waves. The architects, who thought their plans were ready for deep-sea fishing, found themselves needing to re-bait their hooks and rethink their strategies to integrate practices they hadn’t initially considered. But by this time, all the bait had been used up and the engineering team wanted to move on to the next boat. Amid this chaos, the architects had earlier presented the owner with a series of potential design concepts, like a fine selection of prized lures, before the big fishing trip. The owner's feedback, however, was that the lures wouldn't attract the kind of fish they were after; the whole plan was scrapped, and new lures were needed at the last minute. This feedback loop brought humor to the gravity of their predicament, as the architects now scrambled to tie new flies with feathers they didn’t know they’d needed to begin with. Plus, the owner now made it clear that they had specific expectations for ongoing high performance and sustainability goals on the project, based on an article they read and shared (note this was also, at this point, a year after the original contract was signed). So, let this tale be a lesson to all those who set sail on the vast seas of architectural ambition: involve your crew early, listen to the wisdom of your shipmates, and always double-check your fishing license and gear before you leave the dock.
