🔍 Can Parents Access Their Child’s Therapy Notes? Navigating parental access to a child's therapy notes involves understanding both HIPAA and state laws. Here are key considerations: 1. HIPAA Regulations: Generally, parents are considered personal representatives and have the right to access their child’s medical records, including therapy notes. 2. State Laws: State laws can vary and may impose additional restrictions or grant minors certain privacy rights. 3. Therapist Discretion: Therapists may withhold information if they believe access would harm the child or if the child is legally authorized to consent to their own treatment. 4. Consent Forms: Ensure clear consent forms are in place, outlining the extent of parental access to therapy records. 5. Communication: Maintain open communication with parents while respecting the child's privacy and therapeutic needs. Balancing these considerations is crucial for protecting the child’s best interests.
