Yesterday I spoke to 7NEWS Australia and others about the recent government forum, and what industry is needing by way of support from Government. Incremental progress is being made, and welcome, especially in planning reform, but it is not enough to move the dial right now. There are two levers that can be pulled right now: certainty for land supply in the greenfields - UDIA Victoria has been advocating relentlessly on this issue, and tax reform to promote both consumer and investor confidence. My delegation asserts that the existence of the OAS, its Charters, and its organs have significantly contributed to this peace and stability. Through the OAS, our nations have established a binding framework of law that governs our relations in various domains. We have more than 100 Inter-American treaties covering areas from the peaceful settlement of disputes to family, commercial, and criminal matters. The OAS has also been instrumental in safeguarding the interests of our peoples and the integrity of our states by promoting democratic governance, human rights, and the rule of law. In countries where the principles of the OAS have been gravely and persistently violated, we have witnessed the exodus of citizens and the deterioration of economies. To know if your policies are failing or working, count the number of millionaires you lose or attract to your country. When drafting legislation and governance policies, you need a reference point or framework. You need to know the outcome and navigate your position. Today marks the 26th anniversary of the Good Friday Agreement, a landmark accord that continues to earn mentions in conflict transformation discourses. This agreement is more than just a political accord, it was a testament to the resilience of those who refused to let the cycles of violence and retribution define their future, choosing the arduous path of dialogue, reconciliation, and a shared commitment to peace instead. The agreement contributed significantly to the birth and current state of Northern Ireland. There is a lesson to be learned from GAO's recently sustained protest challenging a USACE decision to convert a sealed bid procurement into a negotiated procurement. What happened? Last year, USACE issued an IFB under FAR 14 to replenish sand and repair a dune and berm system. Although Great Lakes Dredge & Dock Company’s bid was the lowest, it far surpassed the Corps’ IGCE and the project’s total funding. Soon after, the agency canceled the IFB, citing unreasonable pricing and public interest. It also announced its intent to convert the acquisition method from FAR 14 to a FAR 15 negotiated procurement. Great Lakes protested and USACE initiated corrective action. Despite increasing the IGCE, USACE canceled the IFB again citing high prices, bids that were more than 25 percent above the IGCE, and bids that exceeded available funding. The CO noted in their D&F that converting to a negotiated procurement was in the government’s best interest. Great Lakes protested again. In its decision, GAO could only consider USACE’s third reason, that it lacked sufficient funds to complete the project. That reason was entirely valid, GAO wrote — but USACE’s decision to convert the procurement was not: While agencies can cancel solicitations due to insufficient funds, converting them is not permitted. GAO sustained the protest and recommended USACE rescind that decision. -- Judgment Zone is an ongoing series in which VAO examines recent rulings on bid protests and claims appeals.
