A digital identity bill went through parliament recently. After reading some of the legislation, there's some good in that organisations providing the identity service can't use the authentication logs to profile users even if they were to receive consent. However, I'm a little unclear about the terms to use the identity information for marketing purposes if the user consents. Count on Future of Privacy Forum's Keir Lamont to find and direct us to the enrolled version of the new Maryland law #MODPA. I posted my to do's based on the Saturday version here: https://lnkd.in/ehE-R3zW The key substantive changes my blackline found were: 🔹 Loyalty programs can't condition participation on the the sale of personal information 🔹 Disclosure re: sale of information for targeted advertising or profiling needs to provide a prominent disclosure /opt out which is clear and easy to understand and unambiguous 🔹 You are not liable for violations of the law by a party with whom you shared data if you did not have actual knowledge that the receiving party would violate AND were and remained in compliance with your obligations as the discloser of the personal data. [The latter part is unlike the other state laws and seems like the "clean hands" requirements some of us learned in administrative law classes...] Any others that you have found Keir Lamont and others? #dataprivacy #dataprotection #privacyFOMO
