This isn't just excellent news, it's also potentially lifesaving! Today the U.S. District Court in Montana granted a preliminary injunction that will permit the Flathead Warming Center--an emergency shelter in Kalispell, Montana--to remain open as the case continues. That means that people that have nowhere else to go won't have to stay out in the freezing cold tonight. It's an important win for all of us concerned with how municipalities abuse the zoning power to keep out people or businesses they don't like. The Kalispell City Council's unwarranted revocation of the warming center's special use permit in September is just one recent example of that abuse. Zoning should not be used to unjustly shut down charitable organizations when they provide vital services to vulnerable populations.
