📢 Last Friday, Module 3: The Law & Economics of Horizontal Cooperation Agreements Kicked Off! ⚖️📊 We were thrilled to launch Module 3 of the LL.M. Program in Competition Law & Economics last Friday. The first session, led by the esteemed Joan de Solà-Morales, focused on the economic assessment of horizontal cooperation agreements under Article 101 TFEU. The discussion explored both the pro-competitive effects of these agreements, such as fostering innovation, cost savings, and efficiency gains, and the anti-competitive risks, including potential collusion and market distortions. Real-world case studies, such as the UK Tractors and Bananas cases, were analyzed to illustrate theories of harm and the practical implications of horizontal cooperation. A special thank you to Joan de Solà-Morales for sharing his expertise and insights as we explore the complexities of cooperation agreements in today’s competitive landscape. Great News! A new contribution to the CELIS Institute Blog Post! While competition law is traditionally not wielded by the European Commission to pursue economic security goals, some of its tools have a geoeconomic edge, like the FSR. One theme for these tools is defining the boundaries between the discretion of the Commission and judicial review. Examining the established practices in 'mainline' competition law may provide clues on where these boundaries may lie and shed light on the depth of jurisdiction.
