If you have elemental rules on your final exams, every analysis sentence you write should include three components: 1. Reference to a fact. 2. The fact’s impact on the element (it either satisfies or negates the element). 3. An explanation why the fact satisfies or negates the element. Assume the intent element of civil battery is defined as, “acting with the desire to bring about a result.” Also assume this fact pattern: Juana did not like Kat because Kat always took Juana’s favorite parking spot at their gym. One morning, Juana saw Kat’s car in her favorite spot, walked in the gym and upon seeing Kat, hit her in the jaw, breaking Kat’s two front teeth. An intent analysis sentence containing all 3 components looks like this: When Juana hit Kat in the jaw at the gym (#1: fact) Juana had the desire to break Kat’s front teeth (#2: impact of fact on the rule) because Juana was angry Kat parked in Juana’s favorite parking spot (#3: explanation why fact satisfies the rule). If your exam included other facts that satisfied the intent element for a different reason, you’d write another analysis sentence with all 3 components specific to those facts. When you understand the elements you have to prove/disprove for every rule, it’s easier to write analysis tailored to each element. And if you write great analysis for every element of your rule, you better prepare to love the grades you’re about to earn! #lawschool #lawstudents #lawstudent
