The Pilot program on the Patent Prosecution Highway (PPH), initiated between the IP Office of Vietnam and the Japan Patent Office (JPO), is presently in Phase 3, which spans three years, i.e., from 2022 to 2025. Each year of the phase comprises two stages: the first stage from April 1 to September 30 and the second stage from October 1 to March 31 of the following year. The program allows a maximum of 100 PPH requests per stage. The IP Office of Vietnam has recently released information regarding the PPH requests in the second year of Phase 3 under the PPH program. As per the announcement, during the second year (October 1, 2023, to March 31, 2024), 55 PPH requests were filed, which is a decrease from the 17 requests in the first stage of the year. The total number of PPH requests for the second year of Phase 3 is 127, falling short of the 200 quota. When comparing the total number of Patent Prosecution Highway (PPH) requests made during the second year of Phase 3 with the previous year, it is observed that there has been a decrease of 3.8%. Specifically, the first year of Phase 3 saw 132 PPH requests, while the second year saw a reduction of 5 requests (i.e., 127 requests). Based on the available data, there is a downward trend in the number of PPH filings. This trend raises concerns regarding the possibility of falling short of the established quota of 200 in the third year of Phase 3.
