Reports are circulating that the International Criminal Court may soon issue arrest warrants against senior Israeli officials. If this were to happen, it could restrict the travel of Israeli officials to more than 120 states that recognize the ICC’s jurisdiction, including countries such as Canada, Australia, the UK, and Germany. ICC warrants could also spur European countries to initiate their own criminal proceedings against Israelis, creating a ‘chilling effect’ that would impact academic partnerships, trade, and even cultural cooperation. The best way to possibly thwart these attempts would be for Israel’s own judicial system to act decisively in cases of suspected violations of international law, and by galvanizing fellow democracies to apply diplomatic pressure on the ICC. It is trite to say that international law and respect for the rule of law are important. But word is cheap. Ultimately, what counts is action. In a recent ruling, the world's top court, the International Court of Justice, took a clear stand on Israel’s activities in Palestinian lands it has controlled since 1967. From the forced displacement and demolition of the homes of Palestinians, the building of settlements, the imposition of restrictions on the free movement of Palestinians, the annexation of large swathes of territory, and more, the ICJ ruled that Israeli conduct contravened international law. Alas, the ruling is non-binding and lacks enforcement power. Israel has also not faced sanctions or punitive actions from any of its allies, beyond nominal words of criticism, exposing the latter to charges of hypocrisy and double standards. If we want to see lasting and meaningful peace and justice in the Middle East, and the world writ large, meaningful actions must be taken to backstop and enforce international law. Taking a long-term enlightened approach, this is also the only feasible way to turn a loser in an international court judgment into a winner, as it too will reap the dividend that comes from peaceful development. #internationallaw #ruleoflaw #publicpolicy (Image: AFP via Getty Images)

World day for International Justice, also known as International Criminal Justice Day is celebrated throughout the world on 17th July as an effort to recognize the emerging system of international criminal justice. International Justice Day commemorates the historic adoption of the Rome Statute on 17th July 1988. The Rome Statute of the International Criminal Court is the treaty that established the international criminal court. It was adopted at a diplomatic conference in Rome, Italy on 17 July 1998 and it entered into force on 1 July 2002. As of February 2024, 124 states are party to the statute, however India is not a member of ICC, along with countries like China, Russia, US etc. According to the treaty, The International Criminal Court is a permanent institution that has the power to exercise its jurisdictions over persons for the most serious crimes of international concern. The Rome Statute established four major international crimes: genocide, crimes against humanity, war crimes and the crime of aggression. International Justice Day marks the importance of continuing the fight against impunity and bringing justice to the victims of war crimes, crimes against humanity and genocide. It is meant to ensure accountability for some of the most serious crimes and remind the world of the ICC which is meant to guarantee justice.

Do you think courts and judicial bodies are the best ways to resolve international disputes like the Russian-Ukrainian war and the #Israel - #Gaza conflict? Since 1945, the concept of courts replacing politics and power has gained significant importance, but doubts remain about their effectiveness in achieving justice. Over the past two years, efforts have been made to subject the Russian war in Ukraine and the Israel-Gaza conflict to international law, highlighting issues of legitimacy, accountability, and authority. Judicializing these conflicts may provoke negative reactions against international systems and hinder international cooperation. We should not expect international courts, with their limited jurisdiction and enforcement mechanisms, to address all violations of #InternationalLaw. The international community must enhance its control through a supportive system that includes courts and key bodies within the #UN framework. 🌍 BETWEEN LAW AND POLITICS: THE INTERNATIONAL CRIMINAL COURT IN THE MODERN AGE I am happy to share my latest article published today in Diário de Notícias, a newspaper of record, delving into the evolution of international justice from World War II, particularly after the horrors of the Second World War which underscored the necessity for accountability in the face of human rights violations. For too long, sovereign immunity shielded leaders from legal repercussions, allowing large scale atrocities to go unchecked. The piece traces the development from ad hoc tribunals (such as the Nuremberg and the Tokyo Military Tribunals) to the establishment of the International Criminal Court (ICC) in 2002. The ICC set a new standard for global justice by targeting individuals, not states, for the gravest of offenses. Yet, the ICC faces significant challenges influenced by global political dynamics, as illustrated by ongoing investigations in the Ukraine and in Palestine and emerging warrants for high-profile leaders, often to no avail. These cases exemplify the ICC's enforcement struggle. The ICC requires comprehensive international cooperation which in turn is dependent on the intricate balance between law and international politics.
