I came across a contract recently which was drafted in a way that tried to exclude liability for any loss or at least that was what was being alledged. Rather than try and exclude everything you may be better off reducing your contractual exposure as outlined in this post by 43Legal. It’s unlikely you will be able to exclude all loss in a contract and therefore, if the provision is unenforceable you could be left in a worse position than had you tried to limit your loss as suggested below. #sme #legaladvice #help
Can I exclude all loss in a contract? It is unlikely that you will be able to exclude all loss. Generally you would probably be best to exclude loss for indirect loss (otherwise known as consequential loss) and then include a cap or limitation clause in terms of limiting a party’s overall liability in terms of direct loss. #business #legal #law
