Four days into the implementation of Oregon's HB 4002, drug possession is criminalized once again. While deflection centers aim to divert individuals from the criminal justice system to treatment, a quick scan of the news shows we still have a complex web of processes, politics, and deeply ingrained stigma to navigate. Recommend proceed with cautious optimism, demand data-driven decisions, and prepare for high variation across the state. Of Oregon’s 36 counties, 28 applied for deflection center grant funding. As of August, only half were projected to be operational by September 1st. Here’s a sample of where things stand: Multnomah County (updated): Opening delayed till October. No sobering beds until mid-2025. If mobile behavioral health outreach fails to make contact within 30 minutes, the individual is taken to jail. Concerns have already arisen from the neighborhood and commissioners about the location. Deschutes County: Set to open this month. The Sheriff's Office is spearheading an officer intervention process with on-scene response from local treatment providers, BestCare and Ideal Option. Officer training sessions on the referral process are planned for later this month. Jackson County: Launching a small pilot in October 2024 with limited law enforcement referrals. Eligibility criteria include restrictions, such as the individual not being on supervision through parole or probation. Douglas County: County-specific plans remain unclear. However, Adapt, has successfully operated a sobering center since 2021, with strong community collaboration and financial support. Addiction is a #ChronicDisease that is #Preventable and #Treatable. Oregon has learned, quickly, that decriminalizing drugs has unintended consequences. Drugs are now illegal once again. For this to work, we must ramp up supports such as mental health services, addiction treatment centers and programs, and sobering beds/houses. A look at the applications for these programs shows interesting disparities between rural counties and more populated counties. It also shows the sober reality of how prepared, or not, the state is to address the realities of this bill. It is sad to me that we take an all or nothing approach to this topic (criminalization) and that we still do not address the root cause of these issues and help people (mental health and addiction support services). #HB4002

Incorporating electronic monitoring (EM) into trauma-informed case management can transform how we approach offender rehabilitation and public safety. By integrating EM technology, such as GPS tracking and alcohol or drug monitoring, we can ensure enhanced supervision while fostering a trauma-sensitive environment. For offenders who have experienced trauma, the criminal justice system can often feel punitive and overwhelming. EM allows for greater flexibility, enabling individuals to remain within their communities, maintain employment, and access mental health or support services, all while under effective supervision. This approach aligns with trauma-informed principles, which emphasize safety, trust, and empowerment. Additionally, electronic monitoring can provide real-time data to case managers, helping them design more responsive and personalized intervention plans. This technology facilitates early identification of risk factors and ensures compliance with court-ordered conditions, reducing the likelihood of reoffending while avoiding the negative impacts of incarceration. By merging EM with trauma-informed practices, we can create a more supportive system that addresses the root causes of offending behavior, promotes rehabilitation, and ensures public safety. Sue the court, sue the jail, and sue the drug manufacturers for the psych meds and the damage it did to your body and sue the city or state for having such a damaging policy of involuntary hospitalization. Just had an interesting experience where my forensic work and therapeutic consulting converged. A consulting client asked me about a particular treatment program for their loved one that was recommended to them by a hospital. I’ve been retained as an expert on two separate occasions for wrongful death cases involving this particular facility. My response, “Oh I wouldn’t do that. When you are charged with a drug offense in Ohio, you may have alternatives to the traditional court process. For example, you could be eligible for drug court, a specialty court aimed at helping you treat your addiction and avoid incarceration. These “courts” involve intensive supervision, treatment, and accountability through drug testing. A recent poll by The Oregonian reveals strong backing among Portland-area voters for the drug re-criminalization law, highlighting a shift in public sentiment toward addressing addiction. While it's sad to see that this shoddy decriminalization plan has chilled the public's perception of the viability of harm reduction approaches. this shif reflects growing concerns over our community wellness as we continue to grapple with very visible manifestations of the rising substance abuse and mental health crisis in this city.
