On March 27th the AER released an update to Manual 012: Energy Development Applications; Procedures and Schedules. While the updates seem minimal, they will have an impact on existing pipeline licenses as well as future projects for pipelines that transport Hydrogen and/or CO2. Next instalment in this week's REMIT-fest: an unofficial consolidation of REMIT and REMIT II, prepared by my colleague Clara Desprez with a bit of help from me. REMIT II rather unhelpfully amends REMIT on the basis of entire clauses, so it's more difficult to see exactly what changes have been made. We have therefore carried out the consolidation on a word-by-word basis, to make it easier to see the differences. For good measure, we have added in the amendments (essentially bringing hydrogen within the scope of REMIT) included in the proposed EU Gas Regulation that is nearing adoption. Those changes are due to take effect 6 months after the Gas Regulation enters into force, so towards the end of this year. The usual disclaimer: this consolidation is an unofficial one that we have prepared for our own convenience and that we are sharing with others likely to find it useful. We have released our final decision on the Gas Distribution Code of Practice. The new code will take effect on 1 October 2024, providing a fair and clear framework for gas network customers as Victoria transitions to net-zero emissions. The new code will: 🔹 Enable us to use our enforcement powers to effectively monitor and enforce the rules on gas distributors, including through civil penalty provisions. 🔹 Require gas distributors to provide clear information to customers on their websites, including how customers can disconnect or abolish their gas connections. 🔹 Remove duplication with other regulations to streamline the regulatory framework. Importantly, the new code also removes inefficient incentives for new gas connections. From 1 January 2025, customers who may seek to establish a new gas connection will pay up-front installation costs for new gas connections, consistent with the current practice for new electricity and water connections. Always good to get a new FOI public authority. “The Independent System Operator and Planner designated in accordance with section 162 of the Energy Act 2023 in respect of information held by it as a result of the exercise of its functions under, or as a consequence of, that Act” will be added to Schedule One of FOIA at such time as the Secretary of State brings into force section 166(2) of the Energy Act 2023 (and consequently these Energy Act 2023 (Consequential Amendments) Regulations 2024). The Alberta Energy Regulator (AER) has released a revised version of Directive 055: Storage Requirements for the Upstream Petroleum Industry The update was to reflect how this directive now also applies to geothermal resource development. References to the Geothermal Resource Development Act and Geothermal Resource Development Rules, as well as other appropriate references to geothermal development, have been added throughout.
