Following with interest as have been since day one and cases in Bermuda and NZ. Where does “incompetent best” sit on the “gross negligence” spectrum ? Looking forward: Will we see more involvement of trustees in regard to scrutiny of investment decisions/ general movement of funds and performance? Audits of investment portfolios? Required by the trust deed itself? What about the holdcos which are typically used ? Can the trustee insist on transaction monitoring? Or wil this push clients to private trust companies ?
