CFPB Rules that #BNPL Lenders Should Be Treated as Credit Cards! In a significant move to enhance consumer protections, the US Consumer Financial Protection Bureau (CFPB) has ruled that Buy Now, Pay Later (BNPL) lenders should be subject to the same regulatory requirements as credit card providers. ⏰HM Treasury’s consultation on BNPL regulation closes on 29 November 2024. Following this, it is expected that the FCA will consult on its rules and proposed approach to authorising BNPL firms. Among the headline points, a new regulated activity will be introduced, and a temporary permissions regime will be put in place for BNPL firms so they can operate until their application for authorisation has been processed by the FCA.

Regulating predatory markets is something governments do all the time. Yet this Government has chosen to exclude Buy Now Pay Later providers from the rules that apply to all other lending, which allows them to set their own credit and default fees. The Hon David Seymour convinced the Cabinet of mostly National Party MPs to go against the position of their own Minister of Commerce and Consumer Affairs, who is ultimately responsible, and adopt what officials call the worst option in terms of consumer protection. That’s despite the Minister of Commerce and Consumer Affairs taking a different preferred option to Cabinet that would have protected consumers.
