On Tuesday, the U.S. Supreme Court will hear Seven County Infrastructure Coalition v. Eagle County, Colorado, its first major case regarding the National Environmental Policy Act (NEPA) in 20 years. What are your thoughts on how this decision could reshape climate change policy? Here is what J.B. Ruhl, a law professor and co-director of the Energy, Environment and Land Use Program at Vanderbilt University, thinks is at stake: "If the court rules that agencies don’t have to consider indirect effects that are out of their direct regulatory control, most agencies could simply ignore indirect climate change impacts, since they have no direct control over sources of greenhouse gas emissions." 💡Read more about this and other views on the #energytransition from Kathari News Perspectives: https://ow.ly/TlQP50UmOse

Trump selects Lee Zeldin to lead EPA. Donald Trump has chosen former New York Congressman Lee Zeldin to head the US Environmental Protection Agency (EPA). Zeldin, known for his strong stance on foreign policy, has not previously focused much on climate, energy, or environmental issues. “It’s an honor to join President Trump’s Cabinet as EPA Administrator,” Zeldin posted on X. “We’ll bring back U.S. energy dominance, revitalize the auto industry, and lead in AI—all while ensuring clean air and water for Americans.” Zeldin’s appointment could drive energy sector growth but leaves uncertainty about environmental and climate issues. The coming years will show if promises of clean air and water will be maintained under real-world policies. This Dentons webinar from our global compliance and investigations group on SCOTUS overturning Chevron will be of interest well beyond the US border, given its relevance to common lawyers, or should that be Common Lawyers (given that I’m both)?
The recent Supreme Court rulings have indicated the Court's intention to limit the authority and discretion that federal agencies have enjoyed over the last several decades. These rulings will assert the power of the federal judiciary, leading to significant ramifications for the regulation of energy, climate policy and more. Don’t miss this discussion with a distinguished panel of industry leaders including The Environmental Council of the States Executive Director Ben Grumbles; Dentons partners Sam Olens and Simon Steel; and Gee Strategies Group President Robert Gee. I can't think of a business that operates in a vacuum, particularly those with environmental or climate impacts. In those worlds, we operate in two regulatory worlds: the compliance and voluntary side. So things a company does because it has to and things it does because it wants to and believe it should do. In the compliance world, the "government" of some kind sets out laws that it expects people to play by. Those laws are then enforced by regulatory agencies of one form or another in accordance with rules. In translating the laws into rules there is a process that is subject to court oversight. Big news in that world is the U.S. Supreme Court's adjustment to that interaction. My Dentons colleagues Clinton Vince, Linda Willard, Sam Olens and Simon Steel in this panel are focussed on: Supreme Court Overturns Chevron Doctrine: Implications for Energy and Climate Policy and Beyond. This significant discussion will have an impact in many other jurisdictions around the world.

The Massachusetts House just took a major step to advance climate legislation this session by voting to pass H.4876, An Act accelerating a responsible, innovative and equitable clean energy transition. "We in Massachusetts have the opportunity to meet our emission goals and unlock our clean energy potential while ensuring that all communities share in the benefits of the net-zero transition. The House has passed thoughtful, targeted legislation that balances our urgent need to build a future-proof electric grid with informed decision-making about equity, land use, and responsiveness to community input" - David Melly, Legislative Director at ELM. ELM thanks Speaker Ronald Mariano, Chair Aaron Michlewitz, and Chair Jeffrey Roy for their dedication to advancing robust legislation and addressing our climate challenges. With less than two weeks until the end of the session, swift work is needed to produce a comprehensive, ambitious final bill. ELM looks forward to continuing to work with bill negotiators in the Legislature to produce consensus legislation that meets the scale and urgency of our statewide environmental challenges.
