Potentially overlooked in the many AI bills signed in California last month, AB 1008 amended the CCPA to provide that personal information can exist in "abstract digital formats," including "artificial intelligence systems that are capable of outputting personal information." In a new blog post from me, Beth Do, CIPP/US, and Stacey Gray, we dig into the bill's ambiguities, potential practical consequences, and preliminary analysis from global regulators on this issue. Many thanks to my colleagues from our Global team for their support on this! https://lnkd.in/ey2Sn34d

This should help with at least two of the taxa in the EU's increasingly complex regulatory structures for the digital economy...
Are you a provider or deployer under the EU AI Act? This might seem like a simple question at first, but the distinctions can easily become blurred and businesses risk unintentionally finding themselves subject to stricter requirements than expected. LexisNexis invited the Ashurst Digital Economy Transactions team (me, David Futter, Nicolas Quoy, Aimi Gold and Siân Deighan) to prepare an article considering the issues. We explain what the definitions are, why the distinction matters, how they can become blurred and some practical safeguards businesses can put in place to avoid falling into the scope of the more onerous provisions. https://lnkd.in/dkgWgK-4

It's good to see the House Financial Services Committee looking at AI and its impact on the financial services industry on a bipartisan basis. Although House Financial Services Chairman Patrick McHenry (R-NC) is retiring at the end of the year, the legislation may help set the tone for the next Congress. It is also a way of ensuring that the House Financial Services Committee maintains jurisdiction over AI legislation impacting the financial services industry. On Sat., Sept. 28, California Gov. Gavin Newsom signed AB 1008 into law, which amends the CCPA's definition of "personal information". "Personal information" now can exist in "abstract digital formats," including "artificial intelligence systems that are capable of outputting personal information." The upshot? Under CCPA, information that exists in AI systems and can identify an individual is personal information, and should be included in the scope of responding to consumers seeking to exercising CCPA rights, such as access, deletion, correction, and opt out.

Since no one protested within 24 hours, I think the EU AI Act is being sent to Council for ministerial approval without a vote at the first available Council. We need to ask Dr. Laura Caroli for confirmation. Meanwhile, in this video lecture, Mr. Tobias Judin of the Norwegian DPA explained what we know about the AI regulation, what it will mean for us and artificial intelligence and how we need to work on this. See https://lnkd.in/eHuBd3R2.
22-04-2024 17:30 The AI Act corrigenda from the IMCO/LIBE committees was just announced by the President of European Parliament and is deemed approved, pursuant to Rule 241(4), unless no later than 24 hours after this announcement, a request is made by a political group or Members reaching at least the low threshold that they are put to the vote. Dr. Laura Caroli explains: "Once these 24 hours lapse (we don’t expect surprises) it will go back to Council for ministerial approval without a vote at the first available Council."
