Really exciting news from Colombia, where the government is turning against ISDS/ corporate courts ahead of a visit by UK minister Douglas Alexander this week. Last Saturday Roy Berreras, Colombian Ambassador to the UK called the effect of ISDS on Colombia a “bloodbath”, called for bilateral investment deals to be “denounced” and calling for the issue to be firmly on the table when Alexander arrives in Bogata in coming days. https://lnkd.in/evXKYTqT Yesterday, the Colombian government said it was indeed preparing to renegotiate all free trade agreements with the US and EU in relation to ISDS. https://lnkd.in/eKSJC_KZ and the Commerce Minister clarified that he wanted investment disputes to be “resolved in the courts of each country, respecting their sovereignty” as currently happens “Between the United States and the European Union”, effectively calling out the neocolonial nature of many ISDS deals. https://lnkd.in/eJVt2h_N Yesterday the civil servants’ union in the British government’s Department for Energy Security & Net Zero and Department for Business & Trade also called for the British government to remove ISDS from the UK-Colombia deal, saying “we need real climate action” https://lnkd.in/e5yf8zxd We fully support the Colombian government’s position. As my colleague Cleodie Rickard writes, Colombia has been particularly devastated by ISDS claims, “Many have been raised by foreign mining companies in direct response to measures taken by Colombia to protect the natural environment and the rights of Indigenous peoples.” https://lnkd.in/eg_yDgn4 In one of the worst cases, mining giant Glencore challenged Colombia when their Constitutional Court suspended a proposed expansion to what is already the largest open pit coal mine in Latin America on the basis that it impacts severely on the local communities ecosystem.
