When artists are free to express themselves, they push the boundaries of creativity, spark meaningful conversations, and offer new ways of seeing the world. This freedom is more than just a legal right—it’s a cornerstone of cultural growth and understanding. That’s why the law is committed to protecting this precious form of expression in several ways: 1. Copyright Protection ensures artists have control over their work and can benefit financially. 2. Freedom of Expression allows artists to create without fear of censorship. 3. Moral Rights ensure artists receive credit and can protect their work from distortion. 4. Art Theft and Provenance Laws help recover stolen works and resolve ownership disputes. 5. Obscenity and Censorship Laws strike a balance between protecting creativity and upholding community values. 6. Public Art and Property Law supports the placement and preservation of public art, ensuring it is respected. Personally, I find that art enriches my life in ways words alone cannot express. Protecting and nurturing artistic freedom ensures we all benefit from the profound connection and understanding that art fosters. It’s a commitment to growth, diversity, and an appreciation of the experiences that shape our world .

A new California law targets unauthorized "digital replicas" of deceased personalities' voices or likenesses in expressive audiovisual works and sound recordings. The measure (AB 1836, Chapter 258, Statutes of 2024) creates a civil cause of action through which the person or entity that controls the personality rights at issue can obtain an award of actual damages or statutory damages of $10,000, whichever is greater. Governor Gavin Newsom signed the bill on September 17, along with another measure (AB 2602, Chapter 259, Statutes of 2024) that requires contracts for personal or professional services to specify the use of #AI-generated digital replicas of a performer’s voice or likeness, and provides that the performer must be professionally represented in negotiating the contract. “The growth of the UK’s creative industries is linked closely to its ability to protect and commercialise its IP,” said Bernard Hay, head of policy at the Creative Industries Policy and Evidence Centre. “A lack of copyright protection for creative content which may be used to train new AI models might not only hamper creatives’ abilities to generate value from their work, but also disincentivise the creation of new IP.”
