📢 [#ADA Implications] A recent lawsuit serves as a grim reminder of the critical importance of ADA protections. Imagine forgetting to water a plant, a necessity for its survival. The outcome is inevitable: it withers. Now replace the plant with a human, and water with insulin. Sounds unthinkable, right? This is the tragic reality for a man with type 1 diabetes in a Philadelphia jail. His life-necessity, insulin, was allegedly neglected, leading to his untimely demise. This case is a potential violation of the Americans with Disabilities Act (ADA) - a law akin to a lifebelt for individuals with disabilities, providing them much-needed protection and respect. As an ADA attorney, it's our duty to ensure this lifebelt is always available and functional. Everyone, irrespective of their circumstances, deserves this protection. Whether you're sailing in calm or turbulent waters, your right to the lifebelt remains unchanged. Remember: Injustice anywhere is a threat to justice everywhere. Let's continue to uphold the rights of all individuals under the ADA and insist on accountability at all levels. OP-ED: Canada needs to make coercive control of elders a crime. On June 12, 2024, the House of Commons unanimously passed Bill C-332, which would make coercive control by intimate partners a separate criminal offence. The proposed law has headed to the Senate for consideration. Bill C-332 is a welcome, non-partisan effort to address domestic violence. However, it does nothing to tackle coercive control by adult children, a pervasive form of elder abuse that violates older victims’ safety, autonomy and dignity. As federal lawmakers wrestle with these concerns, they can take lessons from jurisdictions that have already made coercive control a separate crime. England and Wales were first to create the offence in 2015. Their legislation covers abuse by family members, and in 2023, legislators removed the cohabitation requirement. “The criminalisation of coercive control is an important step forward in securing older people’s right to access criminal justice,” said the Older People’s Commissioner for Wales, an independent watchdog for older people’s rights. There is a clear pathway to keeping children out of the youth justice system. In our submission to a Senate inquiry examining the overincarceration of First Nations children and youth justice systems across Australia, we continue back the recommendations of the Yoorrook Justice Commission. First Nations community-led solutions will work. They must be implemented. In Victoria, First Nations children, children of colour, children with disability and children living in state care are significantly overrepresented at all stages of the criminal legal system. Improving the system for the most marginalised in our community will benefit all. https://lnkd.in/gywmg5s8

We still need this bill to get passed in the U.S House of Representatives to be signed by President Biden but WE ARE SO CLOSE! I am so grateful for the leadership of Senator Schumer who has supported my initiative from the beginning, and to my bill sponsors Senator Jeff Merkley and Senator John Cornyn who I have had the honor to get to know personally and who have been the most dedicated, efficient, and collaborative bipartisan lawmakers. What is SC/ST Act? A Brief Introduction Atrocities against members of the Scheduled Castes and Scheduled Tribes are not a thing of the past. They continue to be a reality in our society even today. Hence, the statutory provisions which have been enacted by Parliament as a measure of protecting the constitutional rights of persons belonging to the Scheduled Castes and Scheduled Tribes must be complied with and enforced conscientiously. Many perpetrators of caste-based atrocities get away scot-free due to shoddy investigations and the negligence of prosecution and this results in low conviction rates under the SC/ST Act giving rise to the erroneous perception that cases registered are false and that it is being misused. As we mark Restorative Justice Week, it is critical to engage in deeper reflection on the evolving frameworks of justice and reconciliation. Restorative justice offers a paradigm shift from traditional punitive systems by centering the needs of victims, encouraging offender accountability, and promoting community healing. At its core, restorative justice emphasizes: 1. Repairing Harm: Instead of focusing solely on punishment, it seeks to understand and address the impact of harm on all involved parties. 2. Active Participation: It involves victims, offenders, and community members in structured dialogue, allowing for a more comprehensive and empathetic resolution process. 3. Community Reintegration: By promoting accountability in a non-punitive way, restorative justice helps reintegrate offenders into society while ensuring that victims’ voices are heard and respected. Emerging research shows that restorative practices can reduce recidivism, strengthen community bonds, and offer more meaningful forms of justice that extend beyond legal sanctions. As scholars and practitioners, we must continue to examine how restorative justice can be more widely applied in various settings—from communities to the criminal justice system—while critically assessing its long-term outcomes and challenges. A troubling paradox of “modern” parenting: A mother can be arrested for allowing her 10-year-old to take a simple walk in the real world, yet no parent is ever held accountable for the countless hours their children are glued to digital screens (often as a way to get rid of them (no wonder birth rates are plummeting in the Western world)). As Jonathan Haidt eloquently highlights below, we overprotect children in the physical world, while leaving them dangerously exposed to the wild, unregulated digital jungle. How do we expect our children’s minds and social skills to develop under these conditions? I often hear parents complain about their children being digitally addicted. We overprotect kids in the real world and underprotect them online. The arrest of a mom in Georgia because her 10-year-old son took a walk should be a wake-up call for America. One lesson should be: parents, go as a group to your local police department and ask them to work with you, to support you as parents and not arrest you. The other lesson is that only 6 states in the US have laws that protect childhood independence (Utah, Colorado, Oklahoma, Texas, Illinois & Virginia). If you're not in one of these 6 states, you can push for your state to pass a "reasonable childhood independence law." See links in comments from Let Grow. Walking down the street at 10 years old is the most normal and one of the healthiest things a boy, or a girl, can do, in the vast majority of neighborhoods, especially if they walk, or play, or bike, or run, together with other kids.
