ACD applauds the U.S. Supreme Court’s ruling today, which will restore checks and balances and return the legislative power back to its Constitutional origins: the U.S. Congress. This decision will also underscore the critical need for future statutes to be clearly defined and unambiguous. This ruling is an important step in reining in administrative overreach that has been taking place for far too long. Read more here ➡ https://lnkd.in/egT2uFJ6

The Federal Executive and Legislative Powers of Mexico refuse to comply with the suspensions decreed by the Judiciary and propose speeding up the election of judges. However, everything is under constitutional review (sub judice) of the constitutional reforms. Even if the Federal Congress rushes to pass secondary legislation, this violates the suspensions, and such secondary laws remain accessory to the principal issue, which are the constitutional reforms under review. https://lnkd.in/gGM4eS7E

First of all, this is a horrible idea. The moment you institute term limits on the Supreme Court, you turn it into a political branch just like the other branches of the federal government. As Justice Clarence Thomas has stated time and time again, the Supreme Court is meant to be the least political branch of the government for the sole purpose of protecting it from being a political weapon rather than an impartial examiner of legislation. During an interview at the University of Notre Dame in 2021, Justice Thomas made these remarks, summarizing the differentiation between the three branches like this: “We judges should do our job and not do anybody else’s job. We are not legislators, we are not politicians. If you want to make policy, and you want to be a politician, then you should run for office.” Of course, judges have their own beliefs, and these beliefs shape their worldview and the approach they will take when interpreting the law. However, just as much, all judges are under oath to preserve the Constitution and determine the constitutional merit of a case of law before ruling on an issue. The moment you impose term limits on the Court—though it sounds very appealing—you transform it from being the pinnacle of one's legal career to merely a step towards another. Judges would then be influenced by the prospect that their decisions on the Court will affect their promotion to other positions, compromising the impartiality and integrity that are crucial to the judiciary's role. #SupremeCourt #Constitution #ClarenceThomas #TermLimits #SeparationOfPowers #RuleOfLaw #LegalEthics #JudicialBranch https://lnkd.in/e8SeXmq9

https://lnkd.in/grcf5rEq "The Constitution of the United States contains a preamble and seven articles that describe the way the government is structured and how it operates. The first three articles establish the three branches of government and their powers: Legislative (Congress), Executive (office of the President,) and Judicial (Federal court system). A system of checks and balances prevents any one of these separate powers from becoming dominant. Articles four through seven describe the relationship of the states to the Federal Government, establish the Constitution as the supreme law of the land, and define the amendment and ratification processes." #NationalConstitutionDay #UTSAEngaged
