I'm reading this statement through the lense of my #humanfactors work with National Institute of Standards and Technology (NIST), and I'm going to point out in the nicest way possible some of my observations. I note there is no one--not a single listed author--that could be clearly associated with the criminal defense community on the title page. I know you're going to tell me that some defense attorney was consulted and not listed as an author but the fact that there are two prosecutors and a forensic scientist with a JD is an immediate concern. We aren't beholden to the government. I'm not beholden to the government. The American Academy of Forensic Sciences has a jurisprudence section and some of it's members are defense attorneys. I'm an independent expert and this document provides me no guidance. Our job isn't to somehow skirt around this ruling and make our jobs as easy as possible and the prosecutors job as easy as possible. We're here to make sure the evidence is presented in it's fullest and fairest light so that the people who have lost (victims) or stand lose (criminal defendants) get justice through a fair trial. The academy intentionally decided not to weigh in on this case. We abstained from filing an amicus. Then this organization that we're a part of issues this? Did we have a vote on whether to be part of this consortium? The document is heavily biased toward the prosecution. We have members like myself, who also work in criminal defense. Lawyers, experts. This statement doesn't represent them and it doesn't guide them. Did we have an option to have our logo on this document? This is the polar opposite of what the membership decided it wanted to do in this controversy. I bet if you asked Christine Funk (she - her) or JD Schmid or Nicolas Hughes or John Lentini, this document wouldn't represent their views or inform the way they deal with this case. "Consequently, prosecutors would be well-served to expect an increase in litigation regarding these issues."   Are we serious? I think this warrants a much larger discussion regarding the affiliation with this group and when the membership is able to weigh in on documents that bear our seal. This does nothing to promote just objective science and I'm very, very, frustrated.
