The government has pledged significant funding to combat tax fraud with hundreds of new HMRC investigators set to be appointed. However, with the number of investigations into serious tax fraud at a record low, questions are being raised about HMRC’s ability to deal with the most complex cases. In a recent Law360 article, David Sleight comments: "Offshore avoidance and evasion cases are notoriously difficult to investigate and enforce. It is inevitably going to take some time for new officers to get up to speed and to be sufficiently competent to undertake these complex investigations." The tax amount involved is 120,000€ or more. (*) Intent can be inferred if you're hiding income, creating fake tax benefits, or issuing false invoices. But, there’s no offense if genuine, non-deductible expenses were deducted without intent to defraud. The statute of limitations is 4 years, but it extends to 5 years in criminal cases.How to Avoid Tax Fraud: Haven’t been inspected yet? You can file a complementary tax declaration and pay the owed tax to correct the situation, but be cautious—if the amount is 120,000€ + you may still face investigation. Form M770: Submit this along with the complementary declaration to pay fines and interest, with a possible 25% reduction. Form M771: Use this if you can’t submit a complementary declaration for the needed period. In the latest developments regarding HMRC’s increased focus on Research and Development (R&D) tax relief claims, dawn raids have been carried out and arrests made on ‘advisors’ that have been suspected to have engaged in fraudulent activities. This is a clear reminder to businesses and advisors that compliance with legislation and HMRC guidelines is essential.
