The right to adequate housing, enshrined in Article 25 of the Universal Declaration of Human Rights and Article 11 of the International Covenant on Economic, Social and Cultural Rights (ICESCR), guarantees everyone access to a safe, secure, and dignified place to live. For undocumented migrants, this right is particularly crucial as they often face unsafe or overcrowded conditions, homelessness, or exploitation by landlords due to their status. General Comment No. 4 of the ICESCR emphasizes that adequate housing must ensure legal security of tenure, affordability, habitability, and accessibility, without discrimination. Migrants are frequently excluded from formal housing markets, making them vulnerable to abuse. Upholding this right means governments must adopt inclusive policies that prevent discrimination and ensure emergency shelters and social housing are accessible to everyone, regardless of migration status.
