The discussion was enlightening. A big thanks to the institute for organizing this and the facilitators for a job well done. A few things I was able to learn. 1. The guidelines are not mandatory .They act as a baseline of persuasive substance in which parties in an arbitration can actually depend on for some sort of direction as to what amounts to conflict of interest and when to disclose such instances. 2. They are applicable to institutions and aim to ensure consistency. This is in turn serves as a comfort to the parties on what to expect in arbitration. 3. They have a ‘traffic lights’ list consisting of red list, the orange list and the green lists. The lists generally encompass what amounts to conflict of interest and the duty to disclose. The standard applicable to all these lists is the perception of the reasonable man i.e. third party. 4. A question was raised on the relevance of these guidelines being reflective of African culture and proceedings. This is due to the complex nature of our relationships with multiple intersections. What would be disclosable in such circumstances? In other words, is there something like ‘over disclosure’? Generally, I garnered that the repercussions of not disclosing would either way be more dangerous to the arbitrator's reputation than an ‘over disclosure’. Similarly, I remembered the phrase that ‘Ceasers wife must be beyond suspicion’. In line with conflict of interest, the duty to disclose helps the arbitrator to be beyond any suspicion that would harm the principle of fairness.
