Disposing of key evidence in a lawsuit before the other side has a chance to inspect it can prejudice the other side. Most attorneys take great pains to preserve evidence and arrange joint inspections for all interested parties. On two of our property damage cases, the plaintiffs disposed key evidence and then told our clients to 'pay up'. In both cases, we moved for spoliation sanctions. In NY, judges can apply the sanctions of dismissal, preclusion of testiomony, or an 'adverse inference' jury instruction concerning the disposed evidence. In this case below, the judge leveled the playing field by granting our clients' request for an 'adverse inference' at trial.
