2023 was a tough year for cannabis and was marked by developments that created a tough business environment including a shrinking workforce, license declines, plateauing sales and diminished stock valuations. Thanks Cannabis LAB - Association of Cannabis Industry Professionals for the opportunity to join this esteemed panel led by Jennifer Makris, MBA where we discussed compliant ways to take the cash out of cannabis banking. Here’s the major takeaways for cannabis operators: + Dispensaries cannot accept credit cards for the direct purchase of marijuana products. This violates the rules of the companies (Visa, Amex, Mastercard, Discover) that run those networks. Anyone who tells you otherwise is lying to you. Period. + Financial institutions aren’t fooled by “crypto hop” solutions where a consumer uses an app to buy a token for the price of a marijuana purchase where the token then gets instantly converted back into fiat currency at the point of purchase. That’s intentionally obscuring the source of funds so that they can be introduced into the financial system. Another name for that is money laundering. + All three of us on the panel agreed that the only sustainable electronic payment methods in cannabis are those that utilize the ACH network run by NACHA. These solutions usually manifest as apps that you directly connect to your bank account. When you make a purchase the payment moves straight from your bank or credit union to the dispensary’s financial institution, entirely avoiding the credit card networks. It also reminded me that the lack of clarity around these fundamental cannabis-specific financial issues means that it’s easy for unscrupulous folks to exploit marijuana business operators that want to find ways to offer electronic payments to an increasingly cashless customer base. If I had a dime for every pitch I’ve received from an electronic payment provider that told me it was “totally legit, trust me bro, I spoke to Visa and they’re cool” then I’d be on a yacht in the Mediterranean right now. Also, just because the dispensary down the street accepts credit cards doesn’t mean they’ll still be doing it next week when Visa finds out what’s going on.
