Given that this week’s blog topic was a discussion about what the future holds for mediation in family law, I’ve been thinking more about the relationship between solicitors and mediators - what our respective roles might look like as time goes on.
In their memorandum outcome, mediators do have the power to create a draft consent order. Of course this is only the first version, with expert legal advice being required in order to formalise this into a legally binding document.
It will be interesting to see whether take up of this service increases, particularly in light of the cost of living crisis and the ongoing family court backlog. The idea being that the more detail that’s encapsulated as soon as an agreement is reached, the less chance there is of this breaking down as matters progress.
