UnitedHealth Group (“UHC”) paid a ransom to protect patient data after a cyberattack on its subsidiary Change Healthcare (“CHC”). While ongoing data review continues, affected health plans and participants haven't been officially notified. UHC found files containing sensitive information affecting many Americans. To mitigate any harm resulting from the CHC breach, we recommend that ERISA-regulated plans which may be impacted by the breach inform their plan participants of the CHC event. Such plans should direct their participants to call the tollfree number (1-866-262-5342) listed on the consumer website to request two years of free credit monitoring. Probably more significant than the cause of the Change Healthcare attack, or the outage it created, or the ransom that was paid: this was also a monstrous data leak, with the PII of potentially “a substantial portion of people in America” slipping into the wrong hands. If you view the latest attack at Ascencion Healthcare within this context, or just consider the awful truth that the Change Healthcare attack was itself rooted in compromised credentials, then you start to see how one breach eventually begets thousands of others. HHS OCR Proposes HIPAA Updates to Improve Data Security (December 31, 2024) The US Department of Health and Human Services (HHS) Office for Civil Rights (OCR) will publish a Notice of Proposed Rulemaking to Strengthen Cybersecurity for Electronic Protected Health Information in the Federal Register on Monday, January 6, 2025. The notice proposed rule comes in response to a “significant increase in cyberattacks and common compliance deficiencies” and will be the first update to HIPAA in more than a decade.
